Federal judge blocks Trump administration's order to deport over 500K migrants with Temporary Protected Status

Obama-appointed Judge Indira Talwani temporarily halted a Trump administration order that would have stripped Temporary Protected Status (TPS) from ~532,000 migrants from Cuba, Haiti, Nicaragua and Venezuela, forcing them to leave by April 24.
The Department of Homeland Security (DHS) had revoked humanitarian protections, giving migrants just 30 days to depart or face deportation, claiming it was sufficient time to "enforce the law."
Talwani ruled the cancellation lacked a "reasoned decision" and was based on a flawed legal interpretation, emphasizing that abruptly ending parole broke prior agreements.
The ruling protects migrants admitted under a Biden policy allowing up to 30,000 people monthly from these nations to enter legally with sponsors – a program Trump officials sought to dismantle.
While immigration advocates denounced the move as an attack on legal migrants, Trump officials (like Stephen Miller) falsely framed the parolees as "illegals" receiving unjust permanent status, while DOJ lawyers claimed other immigration avenues remained open.

A federal judge has temporarily barred a Trump administration directive that would have forced approximately 532,000 migrants from Cuban, Haitian, Nicaraguan and Venezuelan migrants with Temporary Protected Status (TPS) to leave the country by April 24. In March, the Department of Homeland Security (DHS) revoked the humanitarian protections of thousands of migrants, giving beneficiaries 30 days to leave the country or face deportation. "DHS has determined that a 30-day wind-down period provides affected parties sufficient notice while also preserving DHS's ability to enforce the law promptly against those CHNV parolees lacking a lawful basis to remain in the United States. Accordingly, DHS is opting not to increase the wind-down period to more than 30 days," the notice read. However, Obama-appointed U.S. District Judge Indira Talwani of Massachusetts halted the order on April 10. "The nub of the problem here is that the secretary, in cutting short the parole period afforded to these individuals, has to have a reasoned decision," Talwani said. "There was a deal and now that deal has been undercut." The move protects migrants who arrived under a Biden-era program that allowed up to 30,000 people per month from these four nations to enter the U.S. legally, provided they had financial sponsors and arrived at an American airport.

DOJ: Ending the TPS does not exclude migrants from other immigration options

Outside the court, immigration advocates condemned the Trump administration's broader crackdown on all forms of immigration. "We hear the narrative of people coming here illegally and the administration wanting to erase illegal immigration. But we clearly see today that is not the case. Even those people who have legal status, are paying their taxes and working are under attack," said Guerline Jozef, the founder and executive director of the Haitian Bridge Alliance, one of the plaintiffs in the lawsuit. But the Department of Justice, represented by attorney Brian Ward, argued that ending parole does not exclude migrants from other immigration options and claimed they wouldn't be targeted for deportation. Meanwhile, White House Deputy Chief of Staff for Policy and Homeland Security Adviser Stephen Miller blasted the decision in a post on X, formerly known as Twitter. "These are the illegals that Biden flew by airplane en masse into the United States, including the Haitian migrants now occupying Springfield. Biden gave these illegals free housing, healthcare and welfare. Now a local judge says they have to stay here for forever," he wrote on, then concluded "NO."
