The Democrats’ January 6 Committee will conclude its “investigation” on Monday by asking the Department of Justice (DOJ) to prosecute former President Donald Trump, though the committee lacks constitutional authority to do so.
Congressional committees must be organized for a legislative purpose, not as part of a law enforcement action, which is a function of the executive branch under the separation of power in the Constitution.
Nevertheless, the January 6 Committee — in what is expected to be its final act before a Republican-led House takes over next month — is expected to ask the DOJ to prosecute Trump for what it says are multiple crimes.
According to the UK's Daily Mail, "the panel's recommended charges are obstruction of an official proceeding, conspiracy to defraud the United States, conspiracy to make a false statement and 'inciting,' 'aiding' or 'assisting' an insurrection."
One of the committee's most partisan members, Rep. Jaimie Raskin of Maryland, noted if Trump is convicted of the last charge, it is "automatic grounds for disqualification from ever holding public office again, at the federal or state level."
"The President has an affirmative and primary constitutional duty to act to take care that the laws be faithfully executed. Nothing could be a greater betrayal of this duty than to assist in insurrection against the constitutional order," Raskin said, though he literally is sitting on a panel that has no constitutional authority to recommend jack squat to the Justice Department.
"The dangerous assault on American constitutional democracy that took place on January 6, 2021, consists of hundreds of individual criminal offenses. Most such crimes are already being prosecuted by the Department of Justice," he droned on.
"'Ours is not a system of justice, where foot soldiers go to jail and the masterminds and ringleaders get a free pass," he further claimed, which, of course, is one thousand percent not true: Masterminds never go to jail in America, unless, of course, they are Republicans.
"At the heart of our republic is the guarantee of the peaceful transfer of power," anti-Trump Rep. Liz Cheney (R-Wyoming) said at the outset of the hearing. "Every president in our history has accepted this orderly transfer of authority except one."
That's a lie: Trump never told anyone to attack the Capitol Building or stop the Congress from certifying the election. In fact, he told his supporters during a speech prior to the false flag incident to march to the building and demonstrate "peacefully."
"In addition to being unlawful as described in our report, this was an utter moral failure and a clear dereliction of duty," she went on to say.
Cheney was blown out during her August primary by a Trump-backed challenger, Harriet Hageman, who will be sworn in to her seat in a couple of weeks.
The entire Jan. 6 committee was a scam that was always designed to prevent Trump from running again -- because Democrats know they can't beat him in an honest election.
